BUSINESS IMMIGRATION PROGRAMS

Business immigration encompasses various pathways tailored for entrepreneurs, investors, business owners, startup founders, and high-net-worth individuals aiming to immigrate to Canada. These programs enable foreigners and their families to secure Canadian permanent residency by either expanding their businesses abroad, investing in existing Canadian businesses, or initiating new ventures within the country.

Becoming a Canadian citizen requires foreign entrepreneurs and investors to initially acquire permanent residency in Canada. Canadian citizenship is attainable only for individuals who hold Canadian permanent residency and have physically resided in Canada for a minimum of three years.

APPLYING FOR WORK PERMIT FOR CANADIAN INVESTMENT IMMIGRATION

For Korean business operators aspiring to establish business base in Canada, there are several investment immigration options available. After setting up or acquiring Canadian business, business immigrants can apply for work permit to work in Canada.
Intra-company transferees (ICT) Visa
This pathway is available to Korean companies looking to expand into the Canadian market. It caters to entrepreneurs who have established a new branch in Canada while maintaining their company in their home country. Through this route, both the company and its team members can relocate to Canada, with the opportunity to apply for permanent residency after working in Canada for a certain period.
Entrepreneur work permits
This option is for entrepreneurs, high-income earners, and experienced managers who intend to invest directly or start a business in Canada. Work permit holders under this category can operate a business in Canada for a specified period before applying for permanent residency.

Provincial Nominee Program (PNP) Canada Programs
These are diverse opportunities provided by each Canadian province for Korean entrepreneurs seeking investment, business operation, or settlement in specific regions. Ontario and British Columbia's PNP programs are particularly popular among Korean entrepreneurs.
LMIA-based Work Permits
This option, once popular among Korean entrepreneurs and investors, was discontinued by the Canadian government in April 2021. Currently, similar outcomes can be pursued through the general LMIA process or the Entrepreneur Work Permit.

Points to Consider When Applying

Importance of Business Location
If you operate your business from home, the Immigration, Refugees and Citizenship Canada (IRCC) may be suspicious of your employment plan. Therefore, operating from a commercial office or space is crucial to prove the authenticity of your business.
Express Entry와 Canadian Experience Class(CEC)
Business owners applying for permanent residency through the Canadian Experience Class (CEC) program within the Express Entry system may face rejection if their self- employment experience is not recognized as work experience in Canada.
Proof of Business Operations Scale
Failure to prove the scale of your business operations may result in a lack of credibility for your employment offer, leading to issues with your application.
